Welcome to Anchored Souls. These Terms of Service (the “Terms”) govern your access to and use of the Anchored Souls website at www.anchoredsouls.com, our emails, activities, games, stories, resource guides, forms, downloads, and other content or services that link to these Terms (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
1. About Anchored Souls
Anchored Souls is a faith-based senior engagement and resource platform designed primarily for adults age 55 and older, as well as caregivers, families, churches, community organizations, and others who support older adults.
The Services may include:
Daily engagement activities, games, trivia, memory prompts, and brain-friendly recreation;
Devotions, scripture, encouragement, reflections, and other faith-based content;
Blogs, stories, recipes, lifestyle information, and educational materials;
Senior, caregiver, health, safety, financial, legal, transportation, meal, activity, and community-resource information;
The Anchored Club and related email reminders or updates;
Opportunities to submit memories, stories, comments, feedback, or other content;
Community partner, sponsor, organization, program, event, product, or service information; and
Printed or digital books, activity materials, downloads, programs, or other offerings that may be introduced from time to time.
We may add, change, suspend, or discontinue any part of the Services at any time.
2. Eligibility and Acceptable Use
You may use the Services only in compliance with these Terms and applicable law. Although Anchored Souls is primarily designed for older adults, caregivers, and those who serve them, adults of any age may visit the website.
The Services are not directed to children under 13. If you are under 13, do not submit personal information through the Services.
You agree not to:
Use the Services for unlawful, fraudulent, abusive, threatening, harassing, discriminatory, or harmful purposes;
Submit content that infringes another person’s privacy, intellectual-property, publicity, or other rights;
Attempt to gain unauthorized access to the website, accounts, forms, systems, or data;
Introduce viruses, malicious code, automated scraping tools, or other technology that may damage, disrupt, overload, or improperly copy the Services;
Impersonate another person or misrepresent your identity or affiliation; or
Use Anchored Souls content commercially, reproduce it in bulk, or distribute it without prior written permission, except as expressly allowed by these Terms.
We may restrict or terminate access to the Services if we reasonably believe a user has violated these Terms or created a risk to Anchored Souls or others.
3. Informational and Educational Purposes Only
Anchored Souls provides general information, education, encouragement, recreation, and community-resource awareness. The Services are not a substitute for advice from a qualified professional.
Medical and wellness information
Anchored Souls does not provide medical advice, diagnosis, treatment, or emergency services. Health, nutrition, movement, memory, brain-health, caregiver, and wellness content is general in nature. Always consult a qualified healthcare professional regarding a medical condition, medication, diet, exercise program, or change in health.
Participate in physical or wellness activities only as appropriate for your abilities and circumstances. Stop and seek appropriate help if you experience pain, dizziness, shortness of breath, or other concerning symptoms.
Legal, financial, Medicare, benefits, and long-term-care information
Anchored Souls does not provide legal, financial, tax, insurance, benefits, Medicare, or professional care-planning advice. Programs, eligibility rules, contact details, prices, service areas, and laws may change. Confirm important information directly with the responsible agency, provider, or qualified professional before making a decision.
Emergencies
Anchored Souls is not an emergency-response service and does not monitor submissions continuously. If you or someone else may be in immediate danger or needs urgent medical assistance, call 911 or the appropriate local emergency number. Do not rely on a website form, email, resource listing, or social-media message for emergency help.
4. Games, Activities, and Brain-Health Content
Games, puzzles, trivia, memory prompts, word searches, and similar activities are offered for enjoyment and general engagement. They are not clinical tests, cognitive assessments, medical treatments, or guarantees of improved memory, mental function, or health.
Scores, answers, or difficulty with an activity should not be used to diagnose or rule out a medical condition. If you have concerns about memory or cognitive changes, consult a qualified healthcare professional.
5. Faith-Based Content
Anchored Souls includes Christian scripture, prayer, devotionals, reflections, and encouragement. This content is offered for spiritual support and inspiration and is not professional counseling or a substitute for medical, mental-health, legal, or other professional care. Visitors are welcome to use the Services regardless of religious background.
6. Resource Listings and Community Information
Anchored Souls may share information about government agencies, nonprofit organizations, senior centers, transportation providers, meal programs, healthcare organizations, businesses, events, products, or other third parties.
We work to provide helpful information, but we do not guarantee that a listing is complete, current, available, accurate, suitable, licensed, or eligible for a particular person. Inclusion in a directory or resource guide does not mean that Anchored Souls owns, controls, certifies, or guarantees the listed organization or service.
Before sharing personal information, paying money, scheduling a service, traveling, or relying on a provider, you should independently confirm its identity, qualifications, licensing, fees, availability, policies, and suitability.
7. Sponsors, Partners, and Sponsored Content
Anchored Souls may receive payment, financial support, products, services, or other consideration from sponsors and community partners. Sponsored or partner content may include listings, educational materials, promotions, events, or links.
We will identify sponsored content when reasonably appropriate. Sponsorship or partnership does not constitute a guarantee or warranty of a product, service, organization, or result. Unless we expressly state otherwise, sponsors and partners do not control Anchored Souls’ general editorial content, and Anchored Souls is not responsible for a third party’s acts, omissions, products, services, promises, or privacy practices.
Any sponsorship, advertising, resource-listing, or partnership arrangement may also be governed by a separate written agreement. If a separate agreement conflicts with these Terms, the separate agreement controls for that arrangement.
8. Third-Party Websites, Tools, and Services
The Services may link to or use third-party websites, embedded forms, videos, maps, email platforms, social networks, shopping tools, accessibility features, or other services. These third parties operate independently and may have their own terms and privacy policies.
Anchored Souls does not control and is not responsible for third-party content, availability, security, accessibility, pricing, transactions, or practices. A link or integration is provided for convenience and does not necessarily imply endorsement. Your dealings with third parties are between you and the third party.
9. The Anchored Club and Email Communications
If you join the Anchored Club, subscribe to updates, or otherwise provide your email address, you may receive activity reminders, new-content notices, encouragement, program information, or other Anchored Souls communications.
You may unsubscribe from promotional or optional emails at any time by using the unsubscribe link in the email or contacting us. We may still send messages that are necessary to respond to your request, administer an offering, provide a requested item, or address security or legal matters.
You are responsible for providing accurate contact information and for maintaining access to the email account you use.
10. User Submissions, Stories, and Memories
You may have opportunities to submit stories, memories, recipes, photographs, comments, testimonials, answers, feedback, or other materials (“User Content”). You retain ownership of your original User Content.
By submitting User Content, you confirm that:
You created it or have all permissions needed to submit it;
It does not violate another person’s privacy, copyright, trademark, publicity, or other rights;
It is accurate to the best of your knowledge and is not deceptive, defamatory, unlawful, or harmful; and
If it identifies or depicts another person, you have permission to share it, including permission from a parent or legal guardian when required.
You grant Anchored Souls a nonexclusive, worldwide, royalty-free license to review, reproduce, edit for length or clarity, format, publish, display, distribute, archive, and promote the User Content in connection with Anchored Souls and its mission, in any media. This license allows us, for example, to feature a submitted memory on the website, in an email, on social media, or in an Anchored Souls publication.
We may choose not to publish a submission and may edit or remove published User Content at our discretion. Submission does not guarantee publication, compensation, attribution, or confidentiality. Please do not submit sensitive personal, medical, financial, or confidential information.
If you want us to stop using your User Content in future materials, contact us through the Contact page. We will consider reasonable requests, but removal may not be possible from materials already printed, distributed, archived, or shared by others.
11. Our Content and Intellectual Property
Except for User Content and third-party materials, the Services and their contents—including the Anchored Souls name, branding, page designs, original text, graphics, games, activity formats, downloads, compilations, and other materials—are owned by or licensed to Anchored Souls and are protected by applicable intellectual-property laws.
Anchored Souls grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for your personal, noncommercial use. You may print or share a reasonable number of pages for personal use or free use with an individual senior, family member, or caregiving recipient, provided you do not remove ownership notices or imply that you created or sponsor the materials.
Churches, senior centers, care communities, agencies, businesses, and other organizations must obtain written permission before reproducing, posting, distributing, adapting, selling, branding, or using Anchored Souls materials for organizational, promotional, fundraising, or commercial purposes, unless the material expressly states otherwise.
12. Purchases, Paid Offerings, and Refunds
Some current or future products, programs, books, downloads, listings, events, sponsorships, or other offerings may require payment. Prices, billing terms, renewal terms, delivery details, cancellation rights, and refund rules will be disclosed at the point of purchase or in a separate agreement.
By making a purchase, you agree to provide accurate billing information and authorize the applicable payment processor to charge the stated amount. Payment information may be processed by third-party providers and is subject to their terms and privacy practices.
If offering-specific terms conflict with this section, the offering-specific terms control.
13. Privacy
Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that internet transmissions and electronic storage cannot be guaranteed to be completely secure.
14. Availability, Changes, and Technical Issues
We strive to keep Anchored Souls useful and accessible, but we do not guarantee uninterrupted or error-free operation. Pages, links, forms, games, emails, downloads, and third-party features may occasionally be unavailable, delayed, inaccurate, or incompatible with a device or browser.
We may correct errors and change or remove content, features, schedules, eligibility information, or offerings at any time without notice. You are responsible for maintaining the device, software, internet service, and other technology needed to use the Services.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Anchored Souls disclaims all warranties, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, noninfringement, and any warranty arising from course of dealing or usage.
We do not promise that the Services will meet every user’s needs; that resource information will always be current; that activities will produce a particular health, cognitive, emotional, spiritual, or financial result; or that third-party products or services will be safe, suitable, available, or effective.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by law, Anchored Souls and its owners, officers, employees, volunteers, contractors, contributors, sponsors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, personal decisions, or losses arising from or related to your use of or inability to use the Services, reliance on information, participation in an activity, interaction with another user, or dealings with a third party.
To the fullest extent permitted by law, the total liability of Anchored Souls for any claim arising from or related to the Services will not exceed the greater of (a) the amount you paid directly to Anchored Souls for the specific offering giving rise to the claim during the six months before the event or (b) $100.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Anchored Souls and its owners, officers, employees, volunteers, contractors, and representatives from claims, losses, liabilities, damages, judgments, and reasonable costs arising from your unlawful use of the Services, your User Content, your violation of these Terms, or your violation of another person’s rights.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Services will be brought in a state or federal court with appropriate jurisdiction in DeSoto County, Mississippi, and you consent to the jurisdiction and venue of those courts.
Before filing a claim, you and Anchored Souls agree to make a good-faith effort to resolve the dispute informally by providing written notice and allowing at least 30 days for a response, unless immediate court relief is reasonably necessary.
19. Changes to These Terms
We may update these Terms as Anchored Souls grows or as legal, operational, or service requirements change. Updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Services after updated Terms are posted means that you accept the revised Terms.
20. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a reorganization, transfer, or continuation of Anchored Souls.
These Terms, together with the Privacy Policy and any offering-specific or separately signed agreement, constitute the entire agreement between you and Anchored Souls regarding the applicable Services.
